Terms of Service

Effective date: March 5, 2026

1. Acceptance of Terms

By creating an account, accessing, or using Nano Banan Pro ("the Service"), operated by Nano Banan ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Nano Banan.

2. Eligibility

  • You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
  • By using the Service, you represent and warrant that you meet this age requirement.
  • If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Service Description

Nano Banan Pro is an AI-powered image generation and editing platform. We use third-party AI models (including Google Gemini) to process your prompts and generate images. The Service is provided "as is" and output quality, availability, and capabilities may change without notice.

4. Account & Security

  • You are responsible for all activity under your account.
  • You must keep your login credentials confidential. If you suspect unauthorized access, notify us immediately at nanobanan@googlegroups.com.
  • We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.
  • One person or entity may not maintain more than one account without our written consent.

5. Credits, Payments & Refunds

  • The Service operates on a credit-based system. Credits are consumed when you generate or edit images.
  • No refunds for used credits. Once credits have been consumed to generate images, the corresponding payment is non-refundable. By using credits, you acknowledge that the digital service has been fully delivered and that you waive any right of withdrawal for those credits under the EU Consumer Rights Directive (Article 16(m)) or equivalent local law.
  • Unused credit packs: If you purchased a one-time credit pack and have not used any of the credits, you may request a refund within 14 days of purchase by contacting nanobanan@googlegroups.com. After 14 days, or once any credits from the pack have been used, the purchase is non-refundable.
  • Subscriptions: Subscription plans may include monthly credits that expire at the end of each billing cycle and do not roll over. You may cancel your subscription at any time, which will take effect at the end of the current billing period. No pro-rata refunds are given for partial billing periods. Credits included in the current billing cycle remain available until expiration.
  • Chargebacks: Filing a chargeback or payment dispute for charges related to credits you have already used constitutes a violation of these Terms. We reserve the right to immediately suspend your account, forfeit remaining credits, and pursue recovery of the disputed amount plus any fees incurred. We maintain detailed generation logs as evidence of service delivery.
  • We reserve the right to change pricing, credit costs, and subscription plans at any time. Active subscriptions will be honored until the end of the current billing period.
  • All payments are processed through Stripe. By making a purchase, you also agree to Stripe's Terms of Service.
  • You are responsible for any applicable taxes.

6. Acceptable Use

You agree NOT to use the Service to:

  • Generate illegal content, including but not limited to child sexual abuse material (CSAM), non-consensual intimate imagery, or content that violates any applicable law.
  • Generate content that infringes on intellectual property rights of others.
  • Create deepfakes or misleading media intended to deceive, defraud, or harm real individuals.
  • Harass, threaten, defame, or discriminate against any person or group.
  • Attempt to bypass content safety filters or generate content the AI provider has restricted.
  • Reverse engineer, decompile, or attempt to extract source code or models from the Service.
  • Use automated tools (bots, scrapers, etc.) to access the Service without our written permission.
  • Resell, sublicense, or redistribute access to the Service.
  • Interfere with or disrupt the integrity or performance of the Service.

Violation of these rules may result in immediate account termination without refund. We may report illegal content to law enforcement.

7. Content Ownership & License

  • Your inputs: You retain ownership of the text prompts and images you upload to the Service.
  • Generated outputs: Subject to these Terms and applicable law, you own the images generated by the Service from your prompts. However, AI-generated content may not be eligible for copyright protection in all jurisdictions.
  • No storage of prompts or input images: We do not store your text prompts or input images. They are sent directly to the AI provider for processing and are never saved on our servers.
  • License to us: You grant Nano Banan a non-exclusive, worldwide, royalty-free license to process your inputs in real-time solely to operate the Service, and to use generated outputs for our public showcase feature (unless you opt out).
  • Showcase: We may feature generated images in our public showcase unless you opt out. Opting out does not affect previously showcased content.
  • No guarantee of uniqueness: Similar prompts from different users may produce similar outputs. We make no guarantee that outputs are unique to you.

8. Third-Party Services

The Service relies on third-party providers (Google Gemini, Stripe, etc.). We are not responsible for the availability, accuracy, or policies of these third-party services. Their use is subject to their respective terms and privacy policies. Changes to third-party services may affect the Service without prior notice from us.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY OUTPUT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PURPOSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANO BANAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nano Banan, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

13. Termination

  • You may delete your account at any time.
  • We may suspend or terminate your access at our sole discretion, with or without cause, and with or without notice.
  • Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited.
  • Sections 6, 7, 10, 11, 12, and 14 survive termination.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the competent courts of the Netherlands. You waive any objections to jurisdiction and venue in such courts.

15. Changes to These Terms

We may update these Terms at any time. We will notify registered users of material changes via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you disagree with the changes, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nano Banan regarding the Service and supersede any prior agreements.
